These General Terms and Conditions apply to all orders placed by consumers through the online shop operated by:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

The purchase contract is concluded with ReUp UG (haftungsbeschränkt).

The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.

Customers can select products and add them to their shopping cart. Before submitting an order, customers have the opportunity to review and correct their order details.

By clicking the button that submits the order with an obligation to pay, the customer places a binding order for the products contained in the shopping cart.

After receiving the order, the customer receives an order confirmation by email.

All prices displayed in the online shop are stated in euros and include statutory VAT where applicable.

Any additional shipping costs will be clearly displayed before the customer submits the order.

Payment can be made by credit card.

The available payment methods and applicable payment conditions are displayed during checkout.

We currently deliver within Germany.

Delivery will be made to the delivery address provided by the customer during checkout.

The applicable estimated delivery time will be displayed on the relevant product page or during checkout.

If an ordered product is exceptionally unavailable, the customer will be informed without undue delay. Any payments already made for the unavailable product will be refunded.

Products remain the property of ReUp UG (haftungsbeschränkt) until payment has been made in full.

For products that are not prefabricated and are made according to an individual choice or specification of the customer, or that are clearly tailored to the customer's personal needs, the statutory right of withdrawal may not apply.

Where a product is individually made or personalised in this sense, this will be indicated on the relevant product page before the order is placed.

This reflects the statutory exception in § 312g(2)(1) BGB.

Statutory rights relating to defective goods apply.

ReUp products are made using reclaimed tyre inner tubes. Due to the nature and previous life of this material, differences in texture, surface, markings, pattern and finish may occur.

Such material-specific variations do not in themselves constitute a defect, provided that the product otherwise conforms to the agreed characteristics.

ReUp shall be liable without limitation for damage caused intentionally or by gross negligence, for damage resulting from injury to life, body or health, and in all other cases where liability is mandatory by law.

In cases of slight negligence, ReUp shall only be liable for breaches of essential contractual obligations and such liability shall be limited to foreseeable damage typical for this type of contract. In all other cases of slight negligence, liability for damages is excluded.

These limitations also apply in favour of ReUp's legal representatives, employees and agents. Mandatory statutory liability, in particular under applicable product liability law, remains unaffected.

The language available for the conclusion of the contract is English.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive the consumer of protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery, excluding cost of return shipping for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us.

We will make the reimbursement without undue delay and no later than fourteen days after the day on which we are informed about your decision to withdraw from this contract.

We will make the reimbursement using the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and no later than fourteen days from the day on which you communicate your withdrawal from this contract.

The deadline is met if you send the goods before the fourteen-day period has expired.

You are responsible for the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

German distance-selling law requires information on the withdrawal procedure and, where applicable, that the consumer bears return costs.

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and whose production is determined by an individual choice or specification made by the customer, or goods that are clearly tailored to the customer's personal needs.

Please note: This does not affect your statutory rights if a personalised product is defective.

When you visit our website, place an order or contact us, we may process personal data including technical website data, your name, contact details, billing and shipping address, order information and payment-related information.

We process personal data where necessary to operate our website and online store, process and deliver orders, handle payments, respond to enquiries and comply with legal obligations.

Depending on the processing activity, the legal basis is Article 6(1)(b), (c) or (f) GDPR. Where processing is based on your consent, the legal basis is Article 6(1)(a) GDPR.

We use selected service providers to operate our website and online store. These currently include GoDaddy for website infrastructure and hosting, and Shopify for our online shop and payment processing.

Where necessary to fulfil an order, relevant personal data may also be shared with our shipping provider.

Some service providers may process personal data outside the European Economic Area. Where required, appropriate safeguards are used in accordance with the GDPR.

Our website uses cookies and similar technologies necessary for the operation of the website and online shop.

Where non-essential technologies are used for analytics or marketing purposes, we obtain consent where required. Consent can be managed or withdrawn at any time through the Cookie Settings available on our website.

We retain personal data only for as long as necessary for the purposes for which it was collected or as required by applicable statutory retention obligations.

Subject to applicable legal requirements, you have the right to request access to, correction or deletion of your personal data, restriction of processing and data portability. You may also object to certain processing and withdraw your consent at any time with effect for the future.

You also have the right to lodge a complaint with a competent data protection supervisory authority.
